These Terms govern access to and use of the Shikiquote website and any pages, links, widgets, search tools, accounts and services controlled by us (the Website). Shikiquote is a business-discovery, quotation-request, advertising and referral platform. Unless expressly stated otherwise, we do not sell the third-party products or services displayed on the Website and do not receive or hold the customer’s payment for them.

By using the Website or creating an account, you agree to these Terms. You must be at least 18 years old and have legal capacity to enter into a contract. If you do not agree, do not use the Website. The English version prevails to the extent permitted by law; any translation is for convenience only.

1 About Shikiquote

Shikiquote displays business profiles, service information, advertisements and quotation opportunities supplied by independent businesses, tradespeople, professionals and other advertisers (Providers). We may receive subscription, advertising, referral or other fees from Providers. Unless clearly disclosed, users are not charged by Shikiquote for submitting a quotation request.

We may organise Listings by category, location, service area, date, advertising package or other administrative criteria. We do not compare every Provider or claim to cover the whole market, and the absence or position of a Provider is not a statement about its quality. Editorial content and opinions are general information and do not constitute professional advice or an independent guarantee.

2 Third party transactions

When you submit a quotation request or select a Listing, advertisement, link, API, widget or search result, your details may be sent to or you may be redirected to one or more Providers, as explained when you submit the request. Any quotation, appointment, engagement, purchase or other transaction is made directly with the Provider. The Provider’s terms, privacy policy, quotation, price, cancellation and refund conditions apply to that transaction.

Unless a page expressly states otherwise:

• Shikiquote is not the merchant of record or supplier of the advertised product or service;
• the Provider decides whether to respond, provide a quotation or accept requested work;
• payment for the Provider’s work is made to the Provider or its payment service, not to Shikiquote; and
• the Provider is responsible for quotations, contracting, performance, licences, insurance, warranties, variations, cancellations, refunds and customer support.

Shikiquote remains responsible for the services and representations that we ourselves provide and for liability that cannot lawfully be excluded.

3 Checking a Provider and quotation

Before proceeding, check the Provider’s identity, contact details, reputation and any registrations, licences, qualifications or insurance relevant to the service. For work involving children, homes, health, safety or regulated activities, make the additional checks appropriate to your circumstances. An ABN or online review does not by itself guarantee quality or reliability.

Check the quotation, scope of work, total price, deposits, progress payments, mandatory charges, GST treatment, exclusions, expiry date, timing, warranties and cancellation conditions before accepting or paying. If health, mobility, fitness or safety requirements may apply, contact the Provider and seek appropriate professional advice.

4 Quotations prices and availability

Listings may be supplied or updated by Providers or automated third-party systems. Service descriptions, indicative prices, availability and terms may change or contain errors. A Listing or quotation request is not an accepted quotation or confirmed contract. The final written quotation and contract agreed with the Provider apply, subject to applicable law.

We take reasonable care when publishing information but do not guarantee that every Provider will respond, quote, remain available or accept requested work. If a Listing appears inaccurate or concerning, contact the Provider where appropriate and notify us so that we can review it.

5 Images and descriptions

Images may be supplied by Providers, sourced under licence or used for illustration. Screen settings, photography, seasonal conditions and product variations may affect appearance. Unless expressly stated, an image is not a guarantee of precise colour, dimensions, location, inclusions, conditions or results. Verify material details with the Provider before accepting a quotation, engaging the Provider or purchasing.

6 User accounts

An account is optional unless a feature requires one. You must provide accurate information, keep login credentials secure and promptly tell us at info@shikiquote.com.au if you suspect unauthorised access. You are responsible for activity through your account except to the extent caused by our failure to take reasonable security precautions. Third-party sign-in services, where offered, are also governed by their own terms and privacy policies.

Separate advertiser or posting terms may apply to businesses that submit Listings or purchase advertising services.

7 Acceptable use

You must not:

• use the Website unlawfully, fraudulently or in a way that infringes another person’s rights;
• submit false, misleading, defamatory, discriminatory, abusive, obscene or infringing material;
• impersonate another person, create deceptive reviews or provide false transaction information;
• introduce malware, attempt unauthorised access or interfere with the Website’s security or operation;
• scrape, crawl or use automated systems contrary to published instructions or in a way that imposes an unreasonable load;
• harvest personal information or send spam, chain letters or pyramid promotions; or
• bypass access restrictions, moderation processes or technical protections.

8 User content

If you submit a review, comment, photograph or other content, you confirm that you have the necessary rights and that the content is lawful, accurate in all material respects and not misleading or infringing. You retain ownership and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating and promoting the Website.

We may moderate or remove content where reasonably necessary to enforce these Terms, protect users, address a complaint, manage security or comply with law. Publication does not mean we verify or endorse the content.

9 Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary because of a material or repeated breach, fraud, unlawful activity, a security risk, a valid legal request, extended inactivity of an account-based service, or discontinuation of the relevant feature. Where practicable and appropriate, we will provide notice and a reasonable opportunity to respond.

You may request account closure by contacting us. Account information will be retained or deleted in accordance with our Privacy Policy and applicable law. Terms intended to survive termination continue to apply.

10 Third party and related websites

Third-party sites and tools are independently controlled. Shikiquote does not control their content, security, accessibility, availability or privacy practices. A link is provided for convenience and does not by itself amount to endorsement.

Links to another website operated by MULTISEEK may take you to a separate service with its own terms and privacy policy. Review the policies applying to the site you use.

11 Privacy analytics and communications

Our collection, use, disclosure and storage of personal information are described in the Shikiquote Privacy Policy. We and our service providers may use cookies, pixels and similar technologies for essential functions, security, preferences, analytics, affiliate attribution and advertising. Available controls may include a consent tool and browser settings.

We may use analytics or advertising services such as Google products. Those providers may collect information under their own privacy policies. If we send electronic marketing, we will do so in accordance with applicable law and provide a way to unsubscribe.

12 Intellectual property

Unless stated otherwise, the Website and its original text, design, software, branding and compilations are owned by or licensed to Shikiquote and protected by intellectual-property law. Provider names, logos, images and content remain the property of their respective owners.

You may access and print Website content for personal, non-commercial use. You must not reproduce, modify, distribute, sell, republish or commercially exploit it without permission, except where permitted by law.

13 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and its Australian Consumer Law. Where Shikiquote supplies services to you, those services come with any consumer guarantees that apply.

For a problem with a Provider’s quotation, product or service, first contact the Provider shown on the quotation, contract, receipt or payment record. You may also notify us about a Listing, but we cannot approve a Provider’s refund or remedy unless authorised or required by law.

14 Liability

Subject to clause 13 and to the maximum extent permitted by law:

• we are not liable for an independent Provider’s acts, omissions, quotations, content, products, services, insolvency or customer contract;
• we are not liable for loss caused by your failure to check a Provider’s credentials, final quotation or contract terms; and
• we are not liable for indirect or consequential loss that was not reasonably foreseeable, except where liability cannot lawfully be excluded.

These limitations do not apply to loss to the extent caused by Shikiquote’s negligence, fraud, wilful misconduct, breach of contract, misleading or deceptive conduct, or other liability that cannot lawfully be excluded.

15 Indemnity for misuse

To the extent permitted by law, you indemnify Shikiquote against third-party claims and reasonable direct costs arising from your unlawful use of the Website, material breach of these Terms or infringement of another person’s rights. This indemnity is reduced to the extent Shikiquote or another person caused or contributed to the claim or loss.

16 Service availability and security

We do not promise that the Website will always be available, uninterrupted or error-free. We may maintain, secure, modify or discontinue features. You are responsible for reasonable security precautions on your device. We do not warrant that third-party downloads are free from malicious code, but nothing in this clause limits liability that cannot lawfully be excluded.

17 Complaints and assistance

For a complaint about Shikiquote or to report an inaccurate, unsafe or unlawful Listing, email info@shikiquote.com.au. Include your name, the Provider or Listing, a description of the issue, supporting information and the outcome sought. We will acknowledge and respond within a reasonable time, having regard to the nature and complexity of the issue.

Nothing in this clause prevents you from contacting NSW Fair Trading, the Australian Competition and Consumer Commission or another competent regulator or dispute-resolution body.

18 Changes to the Website or these Terms

We may update the Website or these Terms for operational, security, legal or commercial reasons. Updated Terms apply from the effective date displayed and will not retrospectively change a completed transaction or remove rights that cannot lawfully be excluded. We will provide reasonable notice of a material change affecting an account-based service where practicable.

19 Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts and tribunals with jurisdiction in New South Wales. This does not prevent a consumer from exercising a right in another forum where applicable law permits it.

If a provision is invalid or unenforceable, it is read down to the extent necessary; if it cannot be read down, it is severed and the remaining provisions continue.
