These Terms apply when a person submits a solar quote request through the Shikiquote website, an online form, an advertisement or another Shikiquote service. They supplement the Shikiquote Terms & Conditions for Users and Privacy Policy. If there is an inconsistency about a solar quote request, these Terms apply to the extent of that inconsistency.

By submitting a request, you confirm that you are at least 18 years old, have read and agree to these Terms, and are authorised to provide the submitted information. If you submit a request for another person or property, you must have their authority.

1. Definitions

In these Terms, “Shikiquote”, “we”, “us” or “our” means MULTISEEK trading as Shikiquote (ABN 14 977 556 780); “you” means the person submitting the request; “Provider” means an independent solar business that receives or responds to a request; and “request” means the information submitted for a solar quotation or related enquiry.

2. Shikiquote’s role

Shikiquote operates an information, advertising, lead-generation and quote-request platform. We collect and transmit requests to participating Providers. We do not sell, supply, manufacture, finance, design, install, inspect, repair or maintain solar panels, batteries, inverters or related products or services. We do not collect payment for a Provider’s work, control the final price, or enter into a supply or installation contract on your or a Provider’s behalf.

Providers may pay Shikiquote subscription or advertising fees. Users may submit requests without charge unless a charge is clearly disclosed before it is incurred.

3. Sharing your request with Providers

When you submit a request, you direct and authorise us to disclose the request and relevant contact details to participating Providers so they can assess and respond to it. The form or notice presented at submission should identify, or explain the category and intended number, of recipients. A request may be sent to three or more Providers where this is clearly disclosed before submission.

The number of Providers that receive or respond to a request can vary because of location, requirements, service areas, capacity and availability. We do not guarantee any response or any minimum number of quotes.

4. No ranking, recommendation or endorsement

A Provider may receive a request because it subscribes to, advertises with or otherwise participates in Shikiquote and may service the relevant area. Unless expressly stated, display order, inclusion or referral is not a comprehensive market comparison, ranking, recommendation or endorsement. We do not represent that a Provider is the cheapest, best, most experienced or most suitable for you.

5. Independent Providers and contracts

Providers are independent businesses and are not our employees, agents, partners or joint venturers. Any discussion, site inspection, quote, financing arrangement or contract is directly between you and the chosen Provider. Shikiquote is not a party to that relationship and has no authority to bind either party.

6. Your checks and decisions

You are responsible for assessing every Provider and proposal. Before accepting a quote or permitting work, you should independently check:

• the Provider’s identity, ABN or ACN, contact details, reputation and current registration status;
• all licences, electrical qualifications, accreditations and approvals required for the proposed work;
• current public liability, workers compensation and other appropriate insurance;
• system design, site suitability, equipment specifications, installation method and applicable standards;
• written price, inclusions, exclusions, payment schedule, cooling-off rights, timeframes and contract terms;
• product, performance, installation and workmanship warranties and who is responsible for each;
• the basis and assumptions for generation, savings, payback or export estimates; and
• eligibility and conditions for rebates, certificates, feed-in tariffs, finance or other incentives.

Obtain independent legal, financial, electrical, engineering or other professional advice where appropriate. Do not make an advance payment unless satisfied with the Provider, contract, payment protections and applicable law.

7. Provider information and responsibility

Each Provider is solely responsible for its profile, advertising, quotations, representations, advice, system design, products, pricing, finance, installation, workmanship, safety, warranties, after-sales service, repairs, licences, insurance and legal compliance. Information supplied by a Provider is not supplied or independently verified by Shikiquote. Direct complaints about a Provider’s goods or services to that Provider in the first instance, without limiting any rights you may have elsewhere.

8. Quotes, savings and incentives

Quotes, designs, performance forecasts, savings or payback estimates, incentive information and warranty statements come from the relevant Provider unless expressly identified otherwise. Actual output and savings may be affected by weather, shading, orientation, equipment, tariffs, export limits, consumption, maintenance and other factors. Government programs and eligibility can change. You must verify material claims before relying on them.

9. No guarantees

We do not guarantee that a Provider will contact you; that you will receive any particular number of quotes; that a quote is complete, current or the lowest available; that a Provider or system is suitable; that work will begin or finish by a stated time; or that any particular output, saving, rebate, return or other result will be achieved.

10. Information you submit

You must provide accurate, current and reasonably complete information and must not submit unlawful, fraudulent, misleading, abusive or third-party information without authority. We may decline, suspend or stop processing a request that we reasonably believe breaches these requirements or is unsuitable for the service.

11. Contact about your request

By submitting a request, you ask Shikiquote and the disclosed Providers to contact you by telephone, SMS or email for the purpose of responding to that request and related follow-up. This request-specific contact is separate from consent to unrelated marketing. Any optional consent to receive broader direct marketing must be presented and managed separately where required by law.

You may ask a sender to stop marketing communications using its unsubscribe or opt-out method. You may also contact us to stop further referrals by Shikiquote. This cannot retract information already disclosed or stop a Provider with whom you are already dealing; contact that Provider directly. Shikiquote and Providers must comply with applicable privacy, spam, telemarketing and Do Not Call laws.

12. Privacy

We handle personal information in accordance with our Privacy Policy and applicable law, including by collecting, using and disclosing request information to operate the service and connect you with Providers. 13. General information only

Website content is general information only and is not electrical, engineering, financial, legal, taxation or other professional advice. You should not rely on it as a substitute for advice suited to your circumstances.

14. Third-party sites

Links and references to third-party sites are provided for convenience. We do not control those sites and are not responsible for their availability, security, content, products, services or privacy practices. Your dealings with a third party are governed by its own terms and privacy policy.

15. Availability and changes

The platform may be changed, interrupted, suspended or withdrawn. To the extent permitted by law, we do not promise uninterrupted, error-free or continuously available access. We may update these Terms prospectively by publishing a revised version and effective date. The version presented or linked when you submit a request applies to that request unless applicable law requires otherwise.

16. Liability and non-excludable rights

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

Subject to those non-excludable rights and to the maximum extent permitted by law, Shikiquote is not liable for a Provider’s acts or omissions or for loss arising from a Provider’s quote, advice, products, services, finance, installation, delay, warranty, representation or contract. We are not liable for indirect or consequential loss, loss of profit, revenue, opportunity, anticipated savings or data, except to the extent such liability cannot lawfully be excluded.

This clause does not exclude liability caused by our fraud, wilful misconduct, negligence, breach of these Terms or other liability that cannot legally be excluded or limited.

17. Indemnity

To the maximum extent permitted by law, you indemnify Shikiquote and its personnel against third-party claims, losses and reasonable costs arising from information you knowingly submit without authority or that is false or misleading, your unlawful misuse of the service, or your material breach of these Terms. The indemnity is reduced to the extent loss was caused or contributed to by Shikiquote and does not apply where it would be unfair or unlawful.

18. Withdrawal and records

You may ask us at info@shikiquote.com.au not to refer your request to additional Providers. We may retain records as reasonably required for administration, security, dispute management and legal compliance, subject to our Privacy Policy. Withdrawal does not cancel a contract or communication already established with a Provider.

19. Severability and no waiver

If a provision is invalid or unenforceable, it is to be read down to the extent necessary or severed, and the remaining provisions continue. A delay or failure to enforce a right is not a waiver of that right.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia. Subject to any right to bring a claim in another competent forum, the parties submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales and the Commonwealth of Australia.

22. Acknowledgement

By submitting a request, you acknowledge that Shikiquote is a quote-request and lead-generation platform; your request may be disclosed to multiple independent Providers as explained before submission; Shikiquote does not recommend or engage a Provider for you; you must assess each Provider and proposal; and any decision and contract with a Provider is yours.
