The English version of this terms & conditions (agreement) is legally binding. If a translation is provided, it is for user convenience only. Any discrepancy between a translation and the English version, shall result in the English version prevailing. Use of this website (‘’Shikiquote’’, ‘’SQ’’, ‘’website’’, ‘’us’’, ‘’our’’, ‘’we’’) or associated SQ group websites, apps and social media services, etc. is subject to the terms & conditions shown below. This agreement sets forth the legally binding terms for (‘’you’’,‘’your’’ use of SQ. By using SQ, you agree to be bound by this agreement, whether you are a “visitor” or a “posting member”. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this website or mobile app in accordance with all terms and conditions herein. If you do not agree with the terms of this agreement, DO NOT use this website. These terms & conditions may be changed by us in the future without notice. Your continued use of this site constitutes your acceptance of any new or modified terms & conditions.

It is the soul responsibility of any advertising business, to provide full, truthful company and valid licence information including industry required ABN/ACN valid status details, and to hold full insurance relative to your respective industry standard requirements, otherwise do not post your listing on Shikiquote, as you are solely responsible for your work and any interaction on any contracts/arrangements made with customers found through the Shikiquote “Information Only Task Posting Site”. ADVERTISERS MUST READ the full Terms and Conditions following below, before posting.

General
• Any product descriptions or opinions expressed by us on the website and including those in the blog/news section are our own and should not be read as an endorsement of any products or service. We do not compare any third parties, and simply categorize goods and services for sale by category, and/or by date listed. 
• The website is information only, “as is” and “as available”. We will not be held liable for coupons, quotes or otherwise that fail to work, nor do we warrant those coupons, quote, and offers listed on this website will be honoured by any third-party merchant or advertiser. 
• You agree to be responsible for all your use of this website as a posting member (as well as for use of your profile by others, including, without limitation minors living with you).

User Accounts
To post products on our website you will require a sellers account to use our website. You and your representatives will be solely responsible for maintaining the security of your details and any activity on your account. You may where available; use third party services such as your google account to set up an account with us, and you give permission for us to access, store and use that information from such a service as permitted by said services, and in accordance with our own terms & conditions and privacy policy. You agree that you are solely responsible for actions and communications undertaken or transmitted under your account, that relate to your use of or activities on SQ. Further that any of your activity including adds and comments, must not breach any Australian laws (local, state, national) nor international laws. SQ is not responsible or liable for the availability, accuracy, copyright compliance, legality or any other aspect of the advertisements placed on our site. Fees and Taxes
We charge various fees for different packages, for individuals or businesses posting a/an advertisement/s, quote, offers, coupons, promos, etc on our site. You will be able to review all details of a fee before purchasing. Fees are in Australian dollars inclusive of GST. We may on occasion change our fees or offer promotions for advertisements. After a user on our website follows a link to your site for purchase, you are solely responsible for collection of product payments, and for collecting or remitting taxes in connection with your sales of products, services, bookings or otherwise. We are simply and advertising platform, no transactions between sellers (advertisers) and users (customers) takes place on our website. Users after selecting a product listed by you, will be directed to your contact details, website,etc. for all related transactions, tax collection, full product information, etc. for which you must operate under with the full legal and safety compliance expected of all Australian merchants and vendors. Please also read the following policies, as they are binding on you as a seller.

Refunds As much as is authorised by the Competition and Consumer Act of 2010, SD does not provide change-of-mind refunds. There are no refunds for fee’s paid for long-term subscriptions (6months,12 months, etc.). Monthly plans cannot be refunded, the plan will simply stop at the end of the paid period up to 30 days. You have two weeks prior to the due dates to cancel your monthly subscription/ services if you intend to do so.

Posting Location Changes/Modifications We may on occasion change/modify our locations for advertisers to post in. For example if numbers advertising in a certain area become excessive, we may narrow the boundaries of a zone, region or LGA, etc.

Posting Policy and Breaches Persons posting product or service adds are solely responsible for all submitted information to SQ. Adds not complying with posting rules may be removed from the site.

Posting rules include:
• Adds must include GST where a price is listed and pricing must be truthful and not misleading. Read more about ACCC PRICING GUIDELINES  that must be complied with.
• Adds must not breach any Australian law
• Adds must be descriptive in your advertised area of expertise, containing all the necessary and important information that your clients will need
• Adds must be placed in English, nor with any inappropriate language
• Adds must be placed into the correct category
• Adds must no profit from natural disasters
• Adds must be truthful and not misleading in any manner
• Adds must not be racist or discriminative in any manner, and to any group
• Adds must not employing any bypass measures used to prevent or restrict access to the services
• Adds must not be duplicate adds of previously posted advertisements
• Adds must no contain search engine manipulation wording (multiple tags, keyword stuffing, etc.)
• Adds must be transparent in the disclosure of any commercial relationships.
• Adds must not utilize scraper or other automated means to access the service for collection of content without our written permission
• Use of the site must not interfere with other user’s use of SQ nor affiliated or linked websites
• Users must not use or attempt to access another person’s account, service or otherwise without permission from SQ
• Users must not use a false identity on SQ, nor affiliated or linked websites
• Users must not upload or otherwise transmit communications as spam, chain letters, junk mail, pyramid schemes or similar on, or via this site.
• Users must not obtain unauthorized access to SQ or any part of the site that is restricted from general access.
• Users must not harvest or otherwise collect information about others, including email addresses, without their consent
• Users of SQ must not impose an unreasonable load on our infrastructure or interfere with the proper working of the service
Prohibited Products & Advertisements
• Content infringing the rights of third parties including intellectual property rights such as copyright and trademark
• Copying, modifying, or distributing any other person’s content without their consent
• Counterfeit products, replicas, or other brand copies
• Distribute or send communications that contain spam, chain letters, or pyramid schemes.
• Goods or services infringing any copyright without permission to sell or otherwise
• Harvest or otherwise collect information about others, including email addresses, without their consent
• Hazardous materials of any kind including all pesticides and any toxic materials or chemicals
• Illegal drugs, substances, or related manufacturing products
• Illegal goods and services used in any illegal activity
• Impose an unreasonable load on our infrastructure or interfere with the proper working of the service
• Lottery tickets, sweepstakes or any gambling goods or services
• Merchandise goods and services from network marketing companies, independent franchisees. work-from-home, or any similar representatives or enterprise
• Offensive, obscene, pornographic, adult products or any kind including material harmful to minors
• Personal ads relative to escort work, dating or otherwise
• Personal information or mailing lists including the sale of bulk email, Internet Protocol, Instant Messenger, mailing lists with any personal identifying information or similar. Any hardware or software designed to send spam or similar.
• Selling or offering services for supplements/medicine general or pharmaceutical
• Stocks and all securities (including bitcoin, etc. and related mining equipment)
• Stolen property
• Tobacco products, e-cigarettes, etc.
• Used cosmetics or other beauty products
• Used or rebuilt batteries of any kind
Breaching of posting policy and investigation for a suspension and/or removal of an add from the site may be a result of:
A report from a property rights owner, website user, advertiser or from a government department, etc. Also, from routine site checks by SQ.

Termination
You agree that SQ may, at its sole discretion and without prior notice, immediately terminate your profile and access for listing and/or selling products. Cause for such termination shall include but not be limited to;
• A request by law enforcement or other government agency
• A request by you
• Breaches or violations of these terms & conditions, privacy policy or associated guidelines
• Discontinuance or material modification to the service (or any part thereof).
• Extended periods of inactivity.
• Non-payment of any fees owed by you in connection with the services.
• Unexpected technical or security issues or problems.
• You have engaged in fraudulent or illegal activities.
Termination of your profile includes:
• Removal of access to all offerings within the service.
• Where applicable, deletion of your password and all related information, files, and content associated with or inside your account (or any part thereof).
• Barring further use of the service.
Further, you agree that all terminations for cause shall be made solely at SQs discretion and that we shall not be liable to you or any third-party for any termination of your profile or access to details created using the service.

Intellectual Property
• The content and information on SQ including the software and facilities used to create such content, is proprietary to SQ, its affiliates, suppliers, and providers, respectively. SQ authorizes you to view this website for your personal use only (non-commercial or otherwise). You may not modify the materials at the website, nor reproduce, display, perform, distribute, or use them for any commercial or public purpose. Any unauthorized use of any materials on the website may violate copyright, trademark, and any laws (regardless of location where a user is residing). All other logos and trademarks on the website are the property of their respective owners. Any breach of this agreement will result in your authorization to use the website to be terminated, and you must immediately destroy any downloaded or printed materials.

Disclaimers
• We assume no liability for the use or interpretation of any information displayed on this website. SQ displays offers, quote, advertisements, information, and statements (supplied directly from third parties), however we are not obligated to monitor third-party content for accuracy, legality, ownership, etc, and we disclaim all liability for such third-party content.

Furthermore, we make no representation concerning content third-party materials on our website, associated apps, social media platforms, etc. We reserve the right to disable links to or from third-party sites to our website and other associated social media platforms, etc. However, we are under no obligation to do so.

• any contractual claim caused by your use of the services or any customer claim against us, due to your transactions or dealings with a customer
• your non-performance, non-delivery, a theft, or any mistake related to the nonfulfillment of product access to a customer, which you will reimburse us for any loss we may incur because of a related situation caused my you.
• for any defect, recalls and any non-conformity of products for sale by you. That you will reimburse us in fully for any related loss to us, financial or otherwise. You are solely liable for any. and all losses to Us due to a breach of this agreement by you, or anything you do or fail to do, in connection with this agreement.
• any act, neglect or default by any agent, employee, licensee, or customer of yours
• any breaches by you of your obligations in this agreement
any violation or non-compliance of any Applicable Law by you or your products for sale
• any performance failure by you regarding your obligations of this agreement
• any breach of any of the representations made, or warranties provided, by You
• any infringement of any intellectual property rights relating to Products
• any act or omission of Your personnel or any claim brought or directed by Your personnel
• any defect, failure, malfunction, product recall of any Products or Claims arising under the Australian Consumer Law set out in schedule 2 of the Competition and Consumer Act 2010
• any personal injury, death, or property damage related and resultant from any of the matters above
• any financial loss or loss of goodwill or reputation, or any damages arising, directly or indirectly, by your use and/or inability to use our website
These obligations will survive any termination of the Terms.

Jurisdiction
• SQ is located in NSW, Australia, and governed by the laws of the State of New South Wales and the Commonwealth of Australia. Any disputes concerning the website are to be resolved by the courts having juriSQiction in NSW. This site may be accessed throughout Australia only. We make no representations or warranties that the content of this site complies with the laws (including intellectual property laws) of any country outside Australia. If for any reason a court of competent juriSQiction finds any provision or portion of the Terms & Conditions to be unenforceable, the remainder of the Terms will continue in full force and effect. We retain the right to bring proceedings against you for breach of these Terms and Conditions. We reserve the right to seek all fair remedies/solutions for violation of these terms and conditions available at law.
• All members, posters, and users need to work together to keep SQ safe. Please contact us at Contact SQ to report any breaches or service problems you notice on the site. Users and members are solely responsible for any submitted information and any consequences resulting from posts. We reserve the right to refuse or remove content we deem inappropriate or in breach of the terms and conditions. Overall, when required we will assess if an add breaches posting policy and other terms of the agreement. Should we proceed to removal of any post or add, you will be informed by email or similar. Regardless, SQ accepts no liability for service monitoring or for any data or content on the site, nor use of our services.

Modification of Service
We do endeavor to update information on the Website in a timely manner but shall not be liable for delays. SQ reserves the right at any time to modify or discontinue the service (or any part thereof) with or without notice. You agree that SQ shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service. We also reserve the right at any time to change or modify our Terms & Conditions at any time.
